Obama Warms to the Idea of an International Body Having Jurisdiction Over Americans

Proponents of central planning, collectivism and world government such as Amy Goodman, the good comrade in front of the camera at Democracy Now!, are giddy over the recent announcement from the administration of President Barack Obama that the United States may consider re-joining the International Criminal Court [ICC].

Goodman was extremely pleased to report that:

The United States has announced it will attend an International Criminal Court meeting this week as an observer for the first time since The Hague court was set up in 2002. The US signed the ICC treaty during Bill Clinton’s presidency, but it was never ratified by Congress. Clinton’s successor George W. Bush later rejected the idea of joining the court.

The ICC, you may recall, was established by treaty in 1998 to provide a forum in which to try persons who are “accused of the most serious crimes of international concern, namely genocide, crimes against humanity and war crimes.” Although that treaty (known as the Rome Statute) has been ratified by some 110 countries, the United States, which has always opposed the prospect of a foreign body having jurisdiction over American citizens, is not among those nations; nor, for that matter, are Russia, China, or India.

Clinton signed the Rome Statute during the final days of his presidency. George W. Bush, who feared that ambitious prosecutors and judges would subject American soldiers and government officials to politicized prosecutions, subsequently rescinded that signature.

Bush found the following language of a particular provision cited in Article 5, Section 2 of the ICC document particularly troubling:


The Court shall exercise jurisdiction over the crime of aggression once a provision is adopted in accordance with Articles 121 and 123 defining the crime and setting out the conditions under which the Court shall exercise jurisdiction with respect to this crime.

The Bush administration had a major problem with the use of the word “aggression;” and even today, years after the drafting of the treaty, there is still no satisfactory definition as to what constitutes “aggression.” Bush feared that the language was so broad that the potential for abuse in the form of targeted prosecution against American civilian and military leaders was too great a possibility to ignore. Water boarding a suspect, or an Abu Ghraib-type incident, might get an American soldier executed somewhere by a foreign government acting under the jurisdictional control of the ICC.

This was an unacceptable possibility for Bush, but doesn’t seem to be much of an issue for Obama, whose position on the issue was articulated by National Security Advisor Spokesman Ben Chang, who exclaimed during the first month of Obama’s administration that:

We support the ICC in its pursuit of those who’ve perpetrated war crimes.

But why would the folks at Democracy Now! and others on the left be so especially keen on having an International Criminal Court in which to try war criminals? The real answer is chilling.

The left considers the biggest war criminal of all to be none other than: George W. Bush.

Wolfgang Kaleck, general secretary of the leftist European Centre for Human and Constitutional Rights–who has already tried unsuccessfully to sue Bush and former U.S. authorities in European courts–has articulated the left’s position clearly and without ambiguity:

Judicial clarification of the crimes against international law the former U.S. government committed is one of the most delicate issues that the new U.S. president Barack Obama will have to deal with.

Kalek went on to warn the Obama administration that it will have to:

Deal with the turpitudes committed by the Bush government. And, furthermore, the U.S. government will have to pay compensation to the innocent people who were victims of these crimes.

It’s all coming into focus now. What an achievement it would be for the left to have an American ex-President on trial in a foreign court for “war crimes,” with the potential added bonus of a shakedown of the American taxpayer for the payment of crippling “reparations.” Obama would be opening a Pandora’s box with the re-ratification the Rome Statute.

Or is that the plan?

    The birthers are gonna go bonkers over this one. A non-US born president gives authority to an international court to try Americans.

    Hey, would that mean KSM and Hasan’s crimes are worthy of this?

    Hasan’s may be deemed to small but, you see where I’m going with this.

    Notice how this issue and climate change are rebuked by China and Russia. The aspiration for this administration may be one-world-government but, good luck getting the Chinese, Russians and Shari’a cultists on board.

    Maybe the payoff is that Obama gets to rule over this International body? He is a Nobel Peace prize winner after all, give for what he will do in the future.

    The man without a country is still trying to find acceptence, but keeps getting the brush off wherever he goes. He must already be aware that he is no longer welcomed here. Would someone donate a Pacific island for him and his WH buddies, please. Preferable in an area with a bit of sunami activity.

    According to the Constitution, our laws supercede any laws set by any other country. We are a sovereign people, and we do not bow down to foreign governance.

    If they (Anyone who disagrees with our policies) can sue GWB or any soldier in uniform, then they could sue you for breathing and not paying their supposed CO2 tax. They could say your dog is a destroyer of the environment, and needs to die, and that your book against the jihad insults Islam and you could be arrested and convicted.

    There has never been a president of the US tried in a foreign court for any crimes, and that’s because we have the ability to try our own people for our own crimes and our laws are more humane than the rest of the world.

      God Bless You Joe. How I wish we could live in your paradigm forever. But the world has literally changed right beneath our feet, and we no longer control our own lives. When the dollar collapses, as it certainly will, your Constitution will quickly cease to exist.

      10 years ago if you talked about the World Court, you were treated the same way that birthers are treated today.

      20 years ago, if you talked about a one world government, you were treated the same way…

      30 years ago, if you talked about how the Marxists were taking over America, you were treated the same way…

    We,our president and his administration, have finally shown their true colors. This would be an act of treason and a damnation of our own legal system, which is the finest and fairest in the world. There is no equal. This treaty would be disasterous. I was not a Bush fan, but even he saw the pitfalls of doing this. I guess wenow know Obama is dumber than Bush. This country is in real trouble.

    How ’bout this…

    The public trial of KSM fails to get a conviction because of improper questioning of the suspect. KSM wasn’t read his Miranda Rights and therefore any information and confession obtained by that “illegal” interrogation is now discarded by the court. (This of course is known by the Attorney General and the POTUS). However because it has come out in US Federal Court that “torture” was used (a violation of the Geneva Convention?) and that this “torture” was approved by the past POTUS and his administration, they can now be charged by the International Criminal Court for those “crimes”.

    The Attorney General and the POTUS can claim that they tried to get justice for those who died on Sept. 11th, but because torture was used by GWB justice can’t be obtained for the dead. This also will help them justify why GWB and his administration shouldn’t have used “torture” to get information that saved Amercian lives.

    Do they really think that we are so stupid that we can’t see what they are attempting to do?

      How about this? Delays in the trial eventually open up a discussion about trying KSM before the World Court, because it’s the only place he can be tried fairly.

      And then he gets off the hook…

    The elites are using Obama to bring in this New World Order (Globle Goverment) they have been planning this for years.I remember the first Bush and Clinton where talking about this in the early 90 s. If they go along with this that means the constitution will be less relevant.

    HI,i guess you can call me a Birther,if Oreo was truly born in Hawaii,let him prove it.his birth records are sealed,and his african grandmother says she was in Kenya,in the hospital room when he was born,besides that i personally think he is either dumb,or stupid. he has given away enough money to put the USA in debt to CHINA..51 % of the money for the defense budget was borrowed from CHINA !!!i agree with GLENN BECK,Oreo is truly NOT PAYING ATTENTION,now hes pushing a 1900 PAGE HEALTH CARE BILL,that the senators have not read,and oreo has not read it either,now hes talking about making all illegal aliens LEGAL so they can have health care too. this is my rant,if you do not like it TUFF.

      I had thought that if Hillary was elected she would have moved to
      get Bill Clinton in as the new secretary general of the United Nations
      and he then would have the power of the U. S. President to bring
      the world under their control. This may still happen with a few
      variations. The left is devious and full of nasty surprises.

    The government is still subject to the Constitution. Our military
    is sworn to uphold and defend the Constitution. That said I think
    that the Obama crowd will push to far and make it a Constitutional
    crisis, thus Congress must act and if not the last line of defense
    for our Republic is our Military. Hopefully there are enough
    sane Officers to see the threat and will hopefully take action.
    The action would be just and supported by the American public that
    is loyal. The theif in cheif will find his waterloo in his own
    conceit, narcissism and dyspeptic arrogancy. The loons he leads will
    hopefully be identified and deported back to outer space.

      We also have states and states’ governments William. I just wish people would start acting that way. I don’t want to see Palin run for president. I want to see her champion an underground national militia movement to cope with what is coming. And it is coming. We all know it.

      The left realizes the potential of the military. They are taking steps to counter that, I am sure. It grieves me so deeply to say it, but our military will be neutralized in one way or another.

      I am deeply disturbed by the general tone of the conservative movement. We are too focused on Obama, making him the crux of the issue. He is not. When Obama leaves office, he will be replaced by another globalist. Bush, Bush Jr, Clinton, Nixon, Ford… all globalists. Congress has been loaded with globalists for years. The universities, the cultural world, the financial world. Folks, the trend of the world is transnationalism. The people have no choice in the matter anywhere. Same old story.

      I am increasingly convinced that the global banking cartel is running the world through the central banks. The governments of the world are beneath them, just as FDR described. The politicians are their public mouthpieces. The bankers use the governments of the world to pull off one ponzi scheme after another – called “bubbles” – and this is the reality of the world. As Pat Robertson said, these people care NOT what sort of government is in power, nor who runs it, because they control the financial system.

    I guess that is why anyone determined to return financial responsability
    to the nation via the treasury is murdered. Money can buy anything and
    enough money can buy everything……..except our cooperation. The
    American identity is being erased, moral base destroyed, economy
    smashed, future up for grabs. The background growl is getting louder,
    there is not one charasteristic of our being that is not being
    debased in some form or other. What we considered solid individuals
    is a memory and the new emerging individuals will resemble jello
    more than anything else, ready for a government mold. Maybe sports
    fans will get the message and rise up and demand that the ruels be
    obeyed, we have them and they are ignored by those sworn to uphold them.
    There must be a cognizant opposition somewhere. The rabbis of old
    prayed their bones would be in the ground before the days of Jacob’s
    troubles, well fight or flight those days are here.
